Terms and Conditions

These Terms and Conditions form a binding agreement between you and Coral Lantern Rise Kabushiki Kaisha in respect of use of this website and the services described on it.

1. User obligations

1.1 You agree to provide accurate information when submitting an enquiry or engaging a service.

1.2 You agree not to use this website for any unlawful purpose or in a manner that could damage, disable, or impair its function.

2. Liability and warranties

2.1 Content on this website is provided for general information and does not constitute legal advice until a formal consultation has taken place.

2.2 To the extent permitted by Japanese law, Coral Lantern Rise Kabushiki Kaisha excludes liability for indirect or consequential loss arising from use of this website.

2.3 Neither party is liable for delay or failure to perform obligations caused by circumstances reasonably beyond its control.

3. Engagements and fees

3.1 A consultation or drafting engagement is formed when this office confirms in writing the service chosen, its fee, and the materials to be supplied. Current fees are ¥21,500 for a Trademark Filing Consultation, ¥28,500 for Licence Agreement Drafting, and ¥12,800 for a Commissioned Work Rights Consultation.

3.2 Licence Agreement Drafting covers one agreement over a three-week scope with one revision round and a plain-language obligations summary. A second agreement, a counterpart in another language, or revision rounds beyond the first are quoted before any work on them begins.

3.3 A consultation session may be moved by notice given at least two working days in advance. Where an engagement is cancelled after preparatory work such as a registry search or contract review has been carried out, a fee proportionate to that work may be charged and will be explained in writing.

3.4 Fees are payable in Japanese yen. Any official fees charged by the Japan Patent Office, translation costs, or registration costs payable to third parties are separate from this office’s fees.

4. Nature of the advice

4.1 A Trademark Filing Consultation produces a written class recommendation and a summary of a preliminary similarity search. A preliminary search reduces, but cannot remove, the risk that an examiner or a third party later raises an earlier mark; the decision to register rests with the Japan Patent Office.

4.2 The consultation prepares the client to file. Unless otherwise agreed in writing, the application itself is lodged by the client or by a registered patent attorney acting for the client.

4.3 Views on ownership of commissioned work are based on the commissioning documents, invoices, and correspondence the client provides, read against the Copyright Act of Japan. Moral rights of the creator are personal to the creator and cannot be transferred by agreement, and any advice is framed with that limit in mind.

4.4 Where a matter is likely to proceed to litigation or opposition proceedings, this office will say so and the client may need to instruct an attorney qualified to represent it.

5. Confidentiality and client materials

5.1 Unpublished marks, draft product names, licence terms under negotiation, and trade secrets disclosed to this office are kept confidential and used only for the engagement in which they were disclosed.

5.2 The client should supply documents it is entitled to share. Where a draft licence or commissioning contract was provided to the client by another party in confidence, the client is responsible for confirming that it may be shown to an adviser.

5.3 Working files are retained for a reasonable period after an engagement so that later questions on the same mark or agreement can be answered, and are then deleted. Personal information within them is handled in accordance with the Act on the Protection of Personal Information.

5.4 For any engagement, the office’s liability is capped at the fee received for it. The cap does not cover intentional misconduct or gross negligence, and it yields to any rights a consumer client holds under the Consumer Contract Act.

5.5 Where a licence or commissioning agreement drafted by this office is later signed, the client remains responsible for checking that the final signed version matches the reviewed draft. Changes made by the parties after review are outside the advice given.

6. Legal information

6.1 These terms are governed by the laws of Japan, and any dispute is subject to the jurisdiction of the Nagoya District Court as the court of first instance.

6.2 Should any clause of these terms be found unenforceable, the remaining clauses continue in full effect.

6.3 These terms may be updated from time to time; the version published on this page at the time of use applies.

6.4 Questions about these terms may be addressed to Renshi Kadowaki at Coral Lantern Rise Kabushiki Kaisha, 110 Urushiyama, Midori-ku, Nagoya, Aichi 458-0832, by telephone on +81 52-621-2245, or through the contact page.
